1. About these Terms
These Terms of Use govern access to and use of CheckMyRide's website, accounts, vehicle advertisements, dealer profiles, search tools, saved-vehicle functions, communication tools, inspection and valuation services, paid promotion products and any other service made available under the CheckMyRide name.
The Privacy Policy, Listing Rules, Inspection Terms, fee or package information shown before checkout, and any service-specific rules expressly incorporated into these Terms form part of the agreement.
If a service-specific term conflicts with these general Terms, the service-specific term applies to that service. Nothing in these Terms limits a right or remedy that cannot lawfully be excluded or restricted.

References to “CheckMyRide”, “we”, “us” or “our” mean the legal entity identified above. References to “you” or “user” mean any person or organisation using the Services.
2A. Key definitions
For these Terms:
“Services” means the marketplace, account, listing, dealer, communication, inspection, valuation, promotion, payment-related and support functions made available by CheckMyRide.
“Listing” means a vehicle advertisement or inventory entry published or submitted through the Services.
“Seller” means a person or organisation that submits or publishes a Listing, including a Private Seller or Dealer.
“Private Seller” means an individual selling a vehicle in a personal capacity and not as part of a regular vehicle-trading business.
“Dealer” means a business, trader or other commercial seller that offers vehicles in the course of business.
“Inspector” means an individual assigned by CheckMyRide or its contracted service provider to perform an Inspection Service.
“Inspection Service” means a vehicle inspection, inspection plus valuation, report or related service sold by CheckMyRide in its own name.
“Paid Service” means a listing promotion, subscription, Inspection Service or other service for which CheckMyRide charges a fee.
“Promotion” means a featured listing, bump or other paid visibility product.
3. Acceptance and electronic contracting
You accept these Terms when you create an account, tick an acceptance box, post a listing, make a booking, purchase a package, continue to use the Services after being shown these Terms, or otherwise indicate acceptance electronically.
Electronic records, electronic communications and electronically formed contracts may have legal recognition under Sri Lanka's Electronic Transactions Act, No. 19 of 2006, as amended. You agree that electronic acceptance, receipts, notices, records and communications may satisfy requirements for writing, retention and contract formation to the extent permitted by law.
You should save or print a copy of these Terms and any order summary or receipt. CheckMyRide will provide a durable record of paid platform transactions where applicable.
CheckMyRide may retain an audit record of electronic acceptance, including the user or account identifier, date and time, IP address or comparable technical identifier, and the exact version of the Terms accepted, to the extent permitted by law and as described in the Privacy Policy.
4. Eligibility and authority
You may use the Services only if:
- you are at least 18 years old and legally capable of entering a binding agreement;
- the information you provide is accurate, current and complete;
- you are not prohibited by law, court order or prior account suspension from using the Services;
- if you act for a company, dealership, vehicle owner or another person, you have authority to bind and represent that person;
- you use the Services for lawful purposes and comply with these Terms.
A person under 18 may browse public content only under appropriate adult supervision and must not create an account, post an advertisement, purchase a paid service, book an inspection or enter a vehicle transaction.
5. Services covered by these Terms
The Services may include:
- browsing and searching vehicle advertisements;
- private-seller and dealer vehicle listings;
- dealer profile and inventory pages;
- saved vehicles, alerts, contact buttons and messaging tools;
- listing moderation, verification badges and fraud-reporting tools;
- featured listings, bumps, dealer subscriptions, banners and other paid promotional products;
- vehicle inspection booking, inspector assignment, condition reporting and optional valuation services;
- finance or insurance enquiry referrals where separately enabled;
- customer support, complaint handling and safety guidance.
Not every feature is available at all times. A feature shown as testing, beta, pilot or coming soon is not part of the active paid service unless CheckMyRide expressly confirms otherwise.
6. CheckMyRide's role
6.1 Marketplace role
CheckMyRide provides an online marketplace and related tools that enable buyers to discover vehicles and communicate with private sellers and dealers. Unless expressly stated for a specific service, CheckMyRide:
- does not own, possess, sell, purchase or take title to vehicles advertised by users;
- is not the buyer's or seller's agent, broker, auctioneer, dealer, financier, insurer, transporter or legal adviser;
- is not a party to the sale, purchase, lease, exchange, deposit or other vehicle transaction agreed between users;
- does not collect or hold the vehicle purchase price unless a separately disclosed payment or escrow service is introduced;
- does not guarantee that a user will complete a transaction, pay, deliver a vehicle or honour a representation.
A vehicle listing is information supplied by the seller and is not an offer by CheckMyRide. Any vehicle transaction is made directly between the buyer and seller on terms they agree, subject to applicable law.
6.2 Limited verification
CheckMyRide may verify a telephone number, email address, identity document, business registration, dealer location, vehicle document or other information. A verification badge means only that the stated check was completed at a particular time. It is not a guarantee of identity, ownership, title, condition, mileage, accident history, financial standing, legality or future conduct.
6.3 CheckMyRide's direct services
CheckMyRide is directly responsible for Paid Services it sells in its own name, including listing promotions, dealer subscriptions and Inspection Services, subject to these Terms, the package information presented before purchase and mandatory consumer law. CheckMyRide does not act as escrow agent and does not hold buyer-to-seller vehicle purchase funds unless a separately licensed and expressly disclosed service is introduced.
7. Accounts and account security
You must:
- provide accurate registration information and keep it updated;
- use only one personal account unless CheckMyRide authorises additional accounts;
- keep passwords, one-time codes and recovery information confidential;
- not share, sell, transfer or allow unauthorised use of your account;
- notify CheckMyRide promptly if you suspect unauthorised access, impersonation or account compromise;
- ensure that team members using a dealer account have appropriate authority and individual credentials.
You are responsible for activity through your account to the extent caused by your act, omission or failure to take reasonable security precautions. CheckMyRide may require re-verification, password reset, multi-factor authentication or temporary restriction where security concerns arise.
CheckMyRide will never ask you to disclose your password, complete card security code or one-time banking code through a listing message.
8. Private sellers: listing obligations
By posting a vehicle, a private seller represents and agrees that:
- the seller is the legal owner or has written authority from the legal owner to advertise and sell the vehicle;
- the vehicle is not stolen and is not subject to an undisclosed legal restriction, seizure, finance, lease, lien, court order or competing ownership claim;
- the listing is truthful, current, complete and not misleading by statement, omission, image, price or categorisation;
- the stated mileage is accurate to the seller's knowledge and any known odometer replacement, rollback or discrepancy is clearly disclosed;
- known major accident damage, flood or fire damage, structural repair, salvage history and material mechanical defects are disclosed;
- the price is the seller's genuine current asking price, including all mandatory charges imposed by that seller, unless a lawful and clearly explained exception applies;
- photographs and videos show the actual vehicle currently offered and are not copied from another seller without permission;
- the seller will mark the listing sold, remove it or update it promptly when it is no longer available;
- the seller will comply with applicable consumer, motor-vehicle, tax, advertising and other laws.
A private seller must not use a personal account to operate a regular vehicle-trading business or evade dealer verification, dealer subscriptions or legal obligations.
9. Dealers and business sellers
A dealer or business seller must:
- register using the correct business identity and provide requested company, trade, tax, showroom and authorised-representative details;
- ensure every team member is authorised and that account permissions are reviewed when staff leave or change roles;
- publish genuine inventory only and remove sold or unavailable stock promptly;
- maintain documents reasonably necessary to establish ownership, authority, import or registration status and lawful sale;
- disclose all mandatory dealer fees, conditions, warranty terms and material limitations clearly;
- not create fake consumer accounts, fake reviews, false enquiries or artificial engagement;
- comply with the Consumer Affairs Authority Act, applicable directions, standards, warranties and other obligations imposed on traders.
CheckMyRide may require dealer re-verification, inventory audits, proof of ownership, proof of showroom location or other evidence. A dealer badge may be removed or an account restricted if verification expires or concerns arise.
If separate Dealer Subscription Terms are introduced, they will be presented to the Dealer before onboarding or purchase and will apply only after acceptance. Until then, this section and the package information presented at checkout govern dealer use of the Services.
10. Vehicle listing standards
Every listing must:
- use the correct make, model, trim, year, body type, fuel type, transmission and location;
- state mileage in kilometres unless the field clearly permits another unit;
- show the price in Sri Lankan Rupees and use a genuine asking price rather than a misleading placeholder;
- identify the seller as a private seller or dealer;
- use clear, recent images and avoid excessive logos, contact text, misleading overlays or unrelated content;
- avoid unsupported claims such as “accident free”, “original mileage”, “full service history”, “one owner” or “bank approved” unless the seller can substantiate them;
- not display unredacted identity documents, signatures, banking information or unnecessary personal data;
- comply with the detailed rules in Annex 1.
CheckMyRide may correct obvious formatting, categorisation, spelling or image-orientation issues without changing the material substance of a listing. Material changes should be made by the seller or approved through moderation.
11. Buyer responsibilities and safe transactions
A buyer must make an independent decision and perform appropriate checks before paying a deposit, signing an agreement or taking possession.
Buyers should, as applicable:
- inspect and test-drive the vehicle safely or arrange an independent professional inspection;
- verify the seller's identity and authority to sell;
- compare the VIN or chassis number, engine number and registration details on the vehicle with the original documents;
- verify the Certificate of Registration, revenue licence, insurance, emission documents and transfer requirements;
- check for outstanding finance, lease, seizure, police interest, ownership disputes and other encumbrances;
- confirm mileage, service history, accident repairs, import history, recalls and available keys;
- use traceable payment methods and obtain a written receipt and sale agreement;
- avoid sending deposits solely because a seller creates urgency or claims to be overseas;
- never share passwords, card security codes, banking one-time codes or account-recovery codes.
CheckMyRide may publish safety guidance, but such guidance is not a substitute for legal, financial or mechanical advice.
12. Contact, messaging and lead tools
The Services may allow users to call, message or contact each other through telephone, WhatsApp, email or an in-platform tool. Contact information must be used only for a genuine vehicle, dealer, inspection or related enquiry.
Users must not:
- send spam, bulk marketing, unrelated solicitations or repeated unwanted messages;
- harass, threaten, discriminate against or impersonate another person;
- request passwords, one-time codes, full card information or remote access to a device;
- scrape, harvest, sell or reuse contact data for unrelated marketing;
- move a conversation off-platform to conceal fraud or evade a safety restriction.
CheckMyRide may record contact-button events, retain in-platform messages and review communications where necessary for security, moderation, complaint handling and legal compliance, as described in the Privacy Policy.
13. Vehicle inspections and valuations
Inspection and valuation services are governed by these general Terms and the detailed service terms in Annex 2. The customer must review the selected package, price, scope, exclusions, appointment details, cancellation rules and report-recipient details before confirming.
An inspection is a time-limited, visual and non-invasive assessment of accessible areas and functions at the place and time of inspection. It is not a statutory fitness certificate, Vehicle Condition Report (VCR), official Department of Motor Traffic roadworthiness certification, title search, guarantee that every present or future defect will be identified, or substitute for specialist diagnosis where further testing is reasonably indicated.
CheckMyRide will perform an Inspection Service with the reasonable care and skill required by applicable law. Nothing in these Terms excludes liability for a proven failure to exercise such care and skill where liability cannot lawfully be excluded or limited.
A valuation is a professional or market-based estimate made from the information and market evidence available at the relevant time. It is not a guaranteed sale price, finance approval, insurer settlement or binding bank decision.
14. Fees, payments, subscriptions and invoices
The total price payable for a Paid Service, including any VAT, Social Security Contribution Levy (SSCL) or other mandatory tax or charge applicable to that service, will be displayed before confirmation. Optional add-ons, subscription periods, renewal terms and payment methods will be shown separately and clearly. You must be able to review the order and correct any error before payment.
Where paid services are enabled:
- payment may be processed by a third-party payment service provider;
- CheckMyRide should not store complete card numbers or card security codes;
- a receipt or durable transaction record will be provided where applicable;
- a featured listing or bump begins when the promotion is activated, not necessarily when payment is initiated;
- subscriptions will not auto-renew unless the renewal arrangement, duration, price and cancellation method are clearly disclosed before purchase;
- failed or reversed payments may result in suspension of the related paid benefit;
- you remain responsible for bank, card, currency-conversion or third-party charges imposed by your own provider.
- Approved refunds will be routed to the original payment method where reasonably practicable. A chargeback, reversal or disputed payment may suspend the related Paid Service while the payment dispute is investigated, without limiting any statutory right of the user.
All consumer-facing prices are stated in Sri Lankan Rupees (LKR) and are displayed as the total amount payable, inclusive of any VAT, SSCL or other mandatory tax or charge that applies. Where a tax does not apply to CheckMyRide, it will not be charged.
Payments for CheckMyRide Paid Services are processed through third-party payment service providers or bank internet payment gateways. CheckMyRide does not store full payment-card numbers, card security codes or online-banking passwords. The payment provider in use will be identified at checkout where appropriate.
Dealer subscriptions do not auto-renew unless the Dealer expressly selects an auto-renewal option after being shown the renewal period, total renewal price and cancellation method. Any auto-renewal must be capable of being cancelled for future periods through the disclosed method.
15. Cancellations, rescheduling and refunds
The cancellation and refund terms applicable to a paid service must be displayed before confirmation and form part of the transaction. Nothing in this section limits a mandatory consumer right.
15.1 Listing promotions
A featured listing, bump or other digital promotion is generally treated as supplied once activation begins. Subject to law, a refund may be refused after activation where the service operated as described. A refund or replacement may be offered for duplicate charging, material service failure, incorrect activation caused by CheckMyRide or another circumstance required by law.
15.2 Dealer subscriptions
A dealer may cancel future renewal through the disclosed method. Cancellation does not normally reverse a subscription period already started, unless required by law or the service was materially not supplied.
15.3 Inspections and valuations
Inspection cancellations, rescheduling, late arrival, denied access, unsafe locations, unavailable vehicles and inspector cancellation are governed by Annex 3 and the package information shown before checkout. The checkout summary must not conflict with Annex 3.
Standard inspection cancellation rule: cancellation at least 24 hours before the appointment qualifies for a full refund of the inspection fee; cancellation between 12 and 24 hours before the appointment qualifies for a 50% refund; cancellation less than 12 hours before the appointment or a customer no-show is non-refundable, except where mandatory law requires otherwise or CheckMyRide caused the failure.
Rescheduling: one reschedule requested at least 24 hours before the appointment may be made without an additional CheckMyRide rescheduling fee, subject to availability. Later changes may be treated as a cancellation and new booking.
Access denied / vehicle unavailable: if the inspector attends the agreed location and the vehicle cannot reasonably be inspected because access, keys, permission, documents or the vehicle itself are unavailable, the booking may be treated as a customer no-show unless the failure was caused by CheckMyRide.
Refund routing: an approved refund will be initiated to the original payment method without undue delay. The receiving bank or payment provider may require additional processing time outside CheckMyRide’s control.
Where CheckMyRide cannot provide a paid service for reasons within its control, it will offer a reasonable re-performance, rescheduling or refund, subject to the nature of the service and applicable law.
16. Reviews and ratings
If CheckMyRide enables reviews or ratings, the mechanism will be designed to be fair and transparent. Reviews must reflect a genuine experience and must not be false, paid, fabricated or manipulated.
Users must not:
- review themselves, their own business or a competitor without disclosing the conflict;
- offer or accept an undisclosed incentive for a positive review;
- threaten a user to obtain removal of a truthful negative review;
- post private information, defamatory allegations, abusive language or irrelevant content;
- use multiple accounts to change a rating.
CheckMyRide may request evidence that a transaction or service interaction occurred, disclose incentives, remove rule-breaking content and publish both positive and negative reviews on a non-discriminatory basis.
17. Prohibited conduct and prohibited content
You must not use the Services to:
- advertise a stolen, unlawfully obtained, prohibited, unsafe or materially misrepresented vehicle;
- commit or facilitate fraud, online cheating, impersonation, money laundering, theft, forgery or another offence;
- publish a knowingly false or misleading statement, fake document, fake badge, fake price or fake review;
- harass, threaten, dox, discriminate against or publish private information about another person without lawful authority;
- upload content that infringes copyright, trademark, privacy, confidentiality or other rights;
- upload malware, malicious links, harmful code or files designed to compromise a device or account;
- gain or attempt unauthorised access, bypass security controls, probe vulnerabilities or interfere with service availability;
- scrape, crawl, harvest, copy or systematically extract data except through an expressly authorised interface;
- use bots to create accounts, messages, views, leads, ratings or other artificial activity;
- reverse engineer or attempt to discover source code except to the limited extent a prohibition is not legally enforceable;
- circumvent fees, account restrictions, moderation decisions, rate limits or technical controls;
- post pornography, child sexual-abuse material, extremist content, unlawful hate content or other content prohibited by law;
- use the platform for unrelated goods, unlawful services, weapons, regulated products or general classifieds without written approval.
18. Moderation, suspension and termination
CheckMyRide may review, delay, reject, edit for non-material formatting, unpublish, restrict or remove a listing or other content where it reasonably believes that the content:
- breaches these Terms, Listing Rules or applicable law;
- is misleading, unsafe, fraudulent, duplicate, expired, unavailable or improperly categorised;
- creates a security, legal, reputational or consumer-protection risk;
- is subject to a credible complaint, authority request, court order or rights claim;
- requires verification that the user has not completed.
CheckMyRide may warn, restrict, suspend or terminate an account for serious or repeated breach, fraud risk, non-payment, abusive behaviour, security concerns or legal requirements.
Where practicable and lawful, CheckMyRide will provide the reason and an opportunity to correct or appeal. Immediate action may be taken where delay could cause harm, facilitate fraud, compromise security or breach law.
18.1 Statutory notices, scam reports and urgent takedowns
Every Listing may be reported through a “Report Listing” or equivalent safety function. CheckMyRide may request supporting information, preserve relevant records and temporarily restrict a Listing or account while a credible fraud, impersonation, prohibited-content or safety complaint is reviewed.
CheckMyRide may suspend, restrict or remove content immediately, without prior notice where necessary to comply with a lawful court order, law-enforcement request, or notice or directive of the Online Safety Commission or another competent authority. CheckMyRide will keep an internal record of material notices and actions taken to the extent permitted by law.
18.2 Closing your account
You may request closure of your account through the account settings or support channel made available by CheckMyRide. Closing an account will ordinarily end public access to the account and active Listings, but CheckMyRide may retain limited records where reasonably necessary for payment, tax, fraud prevention, safety, complaints, legal claims, audit or another lawful purpose as described in the Privacy Policy. Account closure does not cancel an already supplied Paid Service or remove an accrued payment obligation or statutory right.
Termination does not affect accrued payment obligations, rights arising from an earlier breach, legal records, dispute handling or clauses intended to survive termination.
19. Intellectual property and user content
19.1 CheckMyRide materials
The CheckMyRide name, logos, software, design, databases, text, graphics, classification system and other platform materials are owned by or licensed to CheckMyRide. Except for ordinary use of the Services, no right is granted to copy, reproduce, adapt, sell, distribute, scrape, frame or commercially exploit those materials.
19.2 User content
You retain ownership of content you lawfully own. By uploading a listing, image, video, review or other content, you grant CheckMyRide a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, resize, format, display, distribute and promote that content solely for operating, securing, improving and marketing the Services.
The licence continues while the content is active and for a reasonable period afterward for backups, cached copies, dispute records, fraud prevention and legal compliance. CheckMyRide will not claim ownership of your underlying content.
You represent that you have all rights and permissions needed to upload the content and that its use by CheckMyRide under these Terms will not infringe another person's rights.
19.3 Rights complaints
Intellectual-property notice email: To be confirmed
A rights complaint should identify the protected work or right, the disputed content and URL, the complainant's authority, contact information and a good-faith statement. CheckMyRide may request evidence, notify the uploader and remove or restrict content while the issue is investigated.
20. Third-party services and links
The Services may link to or integrate with third-party websites, maps, WhatsApp, social media, payment providers, vehicle-history services, finance providers, insurers, banks, dealers and inspection partners.
A third party may apply its own terms, privacy policy, fees and eligibility rules. CheckMyRide is not responsible for an independent third party's act, omission, availability or content, except to the extent responsibility cannot lawfully be excluded or CheckMyRide expressly accepts responsibility in writing.
A link, referral or integration does not by itself mean that CheckMyRide guarantees, endorses or is the agent of that third party.
21. Privacy and personal data
CheckMyRide's processing of personal data is described in the Privacy Policy. By using the Services, you acknowledge that the Privacy Policy has been made available to you.
Users must not upload or disclose unnecessary personal data, identity documents, signatures, banking credentials or another person's information without lawful authority.
The Privacy Policy and operational controls must comply with the Personal Data Protection Act, No. 9 of 2022, as amended, from the applicable commencement date and with other currently applicable privacy and consumer obligations.
22. Electronic notices and records
CheckMyRide may send notices, receipts, moderation decisions, security alerts and service communications electronically to your registered email address, account inbox, telephone number or another method selected by you.
You must keep contact details current. A notice is treated as received in accordance with applicable law and the transmission records, unless CheckMyRide receives a clear delivery failure.
System logs, electronic records, account activity, order confirmations and communications may be retained and used as evidence to the extent permitted by law.
23. Availability, changes and technical limits
CheckMyRide aims to provide reliable access but does not guarantee uninterrupted, error-free or permanently available service. Maintenance, updates, cyber incidents, hosting failures, third-party outages, legal restrictions and events beyond reasonable control may affect availability.
CheckMyRide may add, modify, restrict or discontinue a feature. For a paid service, a material adverse change during an active paid period will be handled reasonably, which may include continued access, substitution, credit or refund where appropriate and required by law.
Search rankings, alerts, traffic estimates, view counts, valuation indicators and recommendations may be delayed, incomplete or based on automated systems and should not be treated as guaranteed outcomes.
24. Disclaimers
To the maximum extent permitted by law, and subject to mandatory consumer rights:
- user listings and user communications are supplied by users, not by CheckMyRide;
- CheckMyRide does not warrant the identity, authority, honesty, solvency or future conduct of a buyer, seller or dealer;
- CheckMyRide does not warrant vehicle title, mileage, legality, registration, condition, safety, roadworthiness, accident history, service history, market value or fitness for a purpose;
- a verification badge, moderation approval or inspection report does not eliminate the need for independent checks;
- the platform is provided on an “as available” basis and may contain technical errors or temporary interruptions;
- finance, insurance or third-party eligibility is determined by the relevant third party.
No disclaimer in these Terms may be used to excuse false or misleading conduct, fraud, wilful misconduct, gross negligence, breach of a non-excludable statutory duty or another liability that cannot lawfully be excluded.
25. Limitation of liability
This section applies only to the extent permitted by law. It does not exclude or limit liability for fraud, wilful misconduct, death or personal injury caused by negligence where such liability cannot be excluded, or any mandatory consumer right.
CheckMyRide is not responsible for loss arising solely from a vehicle transaction between users, including the purchase price, deposit, transfer, non-delivery, hidden defect, forged document, outstanding finance or breach by the buyer or seller, unless the loss was caused by CheckMyRide's own breach of a legal duty.
To the extent permitted by law, CheckMyRide will not be liable for indirect or consequential loss, loss of profit, loss of business opportunity, loss of goodwill or loss arising from reliance on user-supplied information where such loss was not reasonably foreseeable from CheckMyRide's breach.
General aggregate liability cap: to the extent a monetary cap is lawful and reasonable, CheckMyRide’s aggregate liability arising from the Services will not exceed the greater of (a) the fees paid by the claimant to CheckMyRide in the 12 months preceding the event giving rise to the claim and (b) LKR 25,000.
Inspection-service liability cap: for a claim arising directly from a proven failure by CheckMyRide or its assigned inspector to exercise reasonable care and skill in inspecting an item expressly included in the purchased checklist and reasonably accessible at the inspection time, the monetary cap will be the greater of five times the inspection fee paid for that inspection and LKR 25,000, except where a higher liability cannot lawfully be limited. This cap must be aligned with CheckMyRide’s professional-indemnity insurance before the Inspection Service is launched.
Any exclusion, limitation or indemnity in these Terms applies only to the extent lawful, fair and reasonable in the circumstances, including under the Unfair Contract Terms Act, No. 26 of 1997. A court or competent authority may disapply a term that cannot lawfully exclude or limit liability.
26. Indemnity
To the extent permitted by law, a seller, dealer or business user must indemnify CheckMyRide and its officers, employees and service providers against a third-party claim, loss, penalty, reasonable legal cost or liability to the extent directly caused by:
- that user's unlawful, fraudulent or misleading listing or conduct;
- a breach of the user's ownership, authority, content-rights or disclosure obligations;
- the sale or attempted sale of a stolen, encumbered, unsafe or materially misrepresented vehicle;
- the user's infringement of another person's intellectual-property, privacy or other rights;
- taxes, fees or legal obligations for which that user is responsible.
This indemnity does not apply to the extent the loss was caused by CheckMyRide's own breach, negligence or unlawful conduct. CheckMyRide must take reasonable steps to mitigate a recoverable loss and allow the indemnifying user reasonable participation in the defence where appropriate.
27. Complaints, disputes and regulatory redress
27.1 Complaints about CheckMyRide

Acknowledgement target: within 2 business days.
Substantive response target: within 14 business days where reasonably practicable, with an update if more time is required because of complexity or third-party evidence.
A complaint should include the user's contact details, relevant account, listing, booking or transaction reference, a clear description and supporting evidence.
27.2 Disputes between users
A buyer and seller should first attempt to resolve their transaction dispute directly and preserve messages, receipts, transfer documents and inspection evidence. CheckMyRide may provide relevant platform records, restrict a listing, facilitate communication or cooperate with authorities, but is not required to adjudicate title, ownership, payment or contractual liability between users.
27.3 Consumer Affairs Authority
A consumer may have the right to complain to the Consumer Affairs Authority of Sri Lanka regarding goods or services. Current official details include:

27.4 Privacy complaints
Privacy complaints and statutory data-subject requests are handled under the Privacy Policy. A person may also have rights before the Data Protection Authority of Sri Lanka.
Nothing in these Terms prevents a user from contacting a regulator, law-enforcement agency or court where entitled to do so.
28. Governing law and jurisdiction
These Terms and any non-contractual obligation arising from them are governed by the laws of Sri Lanka.
Subject to any mandatory consumer right to use another competent forum, the courts of Sri Lanka having competent jurisdiction may hear disputes relating to these Terms or the Services.
Before starting court proceedings, the parties should attempt good-faith written resolution for at least 30 days, unless urgent interim relief, fraud, safety, data protection, a statutory complaint route or a legal deadline requires earlier action.
29. Changes to these Terms
CheckMyRide may update these Terms to reflect changes in law, services, security, pricing or business operations. The current version will show its effective date.
Material changes will be notified through the website, account, email or another appropriate channel. Where required, CheckMyRide will request renewed acceptance before the change applies.
A change will not retrospectively remove an accrued statutory right or alter a completed paid transaction without a lawful basis.
30. General legal provisions

Force majeure | Neither party is responsible for delay caused by an event beyond reasonable control, but this does not excuse payment already due or a duty that law does not permit the party to avoid. |
Headings | Headings are for convenience and do not change the meaning of a clause. |
Language | The English version governs to the extent permitted by law. CheckMyRide should provide Sinhala and Tamil summaries of key consumer-facing information, including cancellation and refund rules, inspection limitations and important safety notices. Any translated legal text should be reviewed for consistency before publication. |

Annex 1. Detailed listing rules
The following rules supplement sections 8 to 10.

Condition | Clearly distinguish brand new, unregistered, reconditioned, used, damaged, accident-repaired, project or parts-only vehicles. |
Ownership and authority | The seller must be the owner or hold documented authority to sell. |
Finance and encumbrance | Disclose outstanding finance, lease, lien, seizure, court order or other material restriction. |
Photos | Use clear images of the actual vehicle. Do not use stock images as the primary images of a used vehicle. |
Documents | Do not publish unredacted NIC, passport, bank, signature or confidential document images. |
Contact information | Use a reachable Sri Lankan number or approved contact method and respond professionally. |
Duplicate listings | Do not repost the same vehicle repeatedly to manipulate ranking or avoid moderation. |

Trade practices | Dealers and traders must comply with consumer law, pricing, warranty, receipt and disclosure duties. |
Public identifiers | Do not display a full VIN or chassis number, unredacted Certificate of Registration, NIC/passport image, signature, QR code or private residential address in the public listing gallery. |
Report listing | Every public listing should provide a clear report/scam function so suspected fraud, impersonation, prohibited content or safety concerns can be escalated. |
Listing moderation outcomes
- Approved: the listing is published.
- Pending verification: documents or information are required.
- Changes requested: the seller must correct identified issues.
- Rejected: the listing cannot be published in its current form.
- Suspended: a live listing is temporarily hidden during review.
- Removed: the listing is taken down due to sale, expiry, breach, risk or legal requirement.
Annex 2. Inspection and valuation service terms
This Annex applies when CheckMyRide offers a vehicle inspection, inspection plus bank valuation, or related report.
A. Booking information
The customer must provide accurate:
- name, email, telephone and authorised recipient details;
- vehicle make, model, year, VIN or chassis number, odometer, registration number and colour;
- ownership type and the seller or dealer contact needed to arrange access;
- vehicle location, access conditions and preferred appointment time;
- inspection package and valuation requirement.
B. Customer responsibilities
- obtain the owner's or seller's permission for inspection and photography;
- ensure the vehicle is present, accessible, reasonably clean and in a safe location;
- provide keys and available documents and disclose known safety risks;
- ensure lawful permission and conditions for any road test;
- not request the inspector to dismantle, damage, conceal or falsify any part of the inspection.
C. Scope and limitations
The exact checklist depends on the purchased package. It may cover vehicle summary, documents, tyres, rims, brakes, suspension, interior, electrical systems, exterior body and paint, engine, transmission, chassis or subframe, diagnostics, road test and general photographs.
Unless expressly included, the inspection does not:
- dismantle components, remove trim or perform destructive testing;
- guarantee detection of intermittent, concealed, internal or future faults;
- verify legal title, stolen status, finance status, customs compliance or document authenticity;
- certify roadworthiness or compliance with every technical or legal standard;
- replace manufacturer diagnosis, specialist workshop testing or laboratory analysis.
D. Road tests and diagnostics
A road test may be omitted where permission, registration, insurance, fuel, safety, weather, traffic, location or vehicle condition makes it unavailable or unsafe. The report should state that the road test was not conducted.
Diagnostic scanning reads information made available by compatible vehicle systems at the relevant time. A clear scan does not prove that no fault exists, and a stored code does not by itself establish the cause or repair cost.
E. Inspection findings and report
Findings represent the inspector's professional opinion based on the accessible condition at the inspection time. Status labels such as Pass, Fail, Attention or N/A are package-defined observations and are not guarantees.
The customer should read the entire report, notes, exclusions, photographs and diagnostic information rather than relying only on a summary score.
The Inspection Service is performed under CheckMyRide’s quality procedures by inspectors engaged under written terms requiring independence of findings, confidentiality, compliance with the inspection checklist and a prohibition on accepting seller payments or altering findings at a seller’s request.
F. Valuation
A valuation is an estimate using available vehicle information, observed condition and market evidence. Market conditions, documentation, location, demand, negotiation and later discoveries may change the achievable price.
A bank, finance company or insurer makes its own independent decision. CheckMyRide does not guarantee that a third party will accept the valuation.
G. Report recipient and sharing
The report will be supplied to the booking customer and any recipient authorised in the booking. The customer is responsible for lawful onward sharing. CheckMyRide may share the report with a bank or other institution only where authorised and lawfully permitted.
H. Complaints about an inspection
A complaint should be submitted promptly with the booking reference, report, photographs, vehicle availability and supporting diagnostic or repair evidence. CheckMyRide may arrange a review, clarification, re-inspection, service credit or refund depending on the facts, package and applicable law.
Inspection complaint period: a complaint should normally be submitted within 7 calendar days after report delivery. A later complaint may still be considered where the issue could not reasonably have been identified earlier or where mandatory law requires a longer period.
Professional indemnity: CheckMyRide must maintain appropriate professional-indemnity cover for the Inspection Service before launch..
Annex 3. Fee, cancellation and refund schedule
This schedule forms part of these Terms. The checkout summary presented before payment must match the applicable service, price, scope and cancellation/refund rule shown here or provide a more favourable term to the customer.
